Welcome to the website of Aerosphere Electric (“Aerosphere Electric,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of:

By accessing or using the Site, or by requesting services from us through the Site, phone, text, email, or lead forms, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Aerosphere Electric is a licensed California contractor (CA LIC #1108650 (C10/C20)) providing residential AC tune-up, AC repair, and AC installation and related services, primarily for homes up to two stories within our service area in California.

1. CONTENT IS INFORMATION ONLY, NOT PROFESSIONAL ONSITE ADVICE
 

1.1 The content on the Site (including articles, FAQs, examples, photos, estimates, and marketing materials) is provided for general informational and promotional purposes only. It is not a substitute for:

  • An in-person inspection or diagnosis by a qualified technician;
     

  • A written quote or proposal tailored to your specific property; or
     

  • Any required permits, engineering, or other professional advice.
     

1.2 HVAC and electrical needs vary by home, system, age, condition, and local code. You should not rely solely on the Site when making decisions about safety, repair, replacement, or installation. You agree that any actions you take based on Site content are at your own risk.

1.3 Actual services, recommendations, and pricing will be based on onsite evaluation and any separate written service agreements, work orders, or invoices presented to you at or before the time of service.
 

 

 

2.ACCESSIBILITY


We aim to make the Site accessible and usable for people with and without disabilities. 3. UPDATES TO THESE TERMS
 

We may update, modify, or revise these Terms at any time. When we do, we will update the “Last Updated” date at the top of these Terms. Changes become effective when posted on the Site.

Your continued use of the Site after changes are posted means you accept the updated Terms. If any part of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
 

 

 

4. USE OF THE SITE; ELIGIBILITY & LICENSE
 

4.1 Eligibility
You may use the Site only if you:

  • Are at least 13 years old; and
     

  • Use the Site in compliance with these Terms and all applicable laws.
     

To request and enter into service agreements or pay for services, you represent that you are at least 18 years old or have appropriate authority or consent from a parent, guardian, or property owner.
 

4.2 License to Use the Site
Subject to these Terms, Aerosphere Electric grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use to learn about and request residential HVAC services from us.

 

4.3 Prohibited Uses
You agree not to:

  • Copy, reproduce, distribute, publicly display, sell, or exploit any part of the Site or its content, except as expressly allowed by these Terms;
     

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Site;
     

  • Create derivative works or adaptations of the Site or any associated technology;
     

  • Remove, obscure, or alter any copyright, trademark, or proprietary notices on the Site;
     

  • Frame, mirror, or otherwise incorporate the Site or any part of it into another website or application without our prior written consent;
     

  • Use the Site for any unlawful, fraudulent, or malicious purpose, or to solicit others to engage in such activities;
     

  • Attempt to gain unauthorized access to any accounts, systems, or networks connected to the Site;
     

  • Interfere with any security or access-control features of the Site;
     

  • Introduce viruses, malware, or other harmful code;
     

  • Submit any content that is unlawful, harmful, threatening, harassing, defamatory, obscene, hateful, or otherwise objectionable;
     

  • Submit false, misleading, or incomplete information when requesting services; or
     

  • Violate the intellectual property, privacy, or other rights of Aerosphere Electric or any third party.
     

We may suspend or terminate your access to the Site at any time, in our sole discretion, for any violation of these Terms or for any other reason.

5. CONSUMER COMMUNICATIONS & CONSENT (CALLS/TEXTS/EMAILS)
 

5.1 Communication Methods
By providing a phone number or email address to Aerosphere Electric (including through the Site or Meta/Facebook/Instagram lead forms), you agree that we may contact you using:

  • Phone calls (live and, where permitted by law, automated);
     

  • Text messages (SMS/MMS); and
     

  • Emails,
     

for purposes that include:

  • Responding to your requests and inquiries;
     

  • Scheduling, confirming, or rescheduling appointments;
     

  • Providing service updates and follow-ups; and
     

  • Sending limited promotional or marketing messages about our services, where permitted by law.
     

5.2 Consent and Opt-Out

  • Your consent to receive calls or texts is not required to purchase goods or services from us.
     

  • Standard message and data rates may apply. Not all carriers or devices may be supported.
     

  • You may opt out of marketing or informational text messages at any time by replying “STOP” to a message we send.
     

  • You may opt out of marketing phone calls by telling our representative during a call or by contacting us using the information at the end of these Terms.
     

  • You may opt out of marketing emails by clicking “unsubscribe” in the message or contacting us.
     

5.3 Accuracy of Contact Information
You represent that the phone number(s) and email address(es) you provide belong to you or that you have the authority to provide them and receive communications. You agree to promptly notify us if you change or deactivate any contact number or email to help prevent communications intended for you from being directed to someone else.

 

5.4 Call Recording (Where Permitted)
Where allowed by applicable law, we may monitor or record phone calls with you for quality assurance, training, and recordkeeping purposes. By continuing with a call after any required notice, you consent to such monitoring or recording.



 

6. PRIVACY POLICY
 

Your use of the Site is also governed by our Privacy Policy – Aerosphere Electric, which is incorporated by reference into these Terms. Please review the Privacy Policy to understand how we collect, use, and share your information.


 

7. SERVICE OFFERS, PROMOTIONS & ESTIMATES
 

7.1 General Promotions
From time to time, we may advertise special offers or promotions, including discounted inspections (such as a $49 inspection), seasonal tune-ups, or other pricing incentives. Unless expressly stated otherwise in the specific promotion:

  • Promotions apply to residential properties only, generally homes up to two stories within our service area in California;
     

  • Promotions are time-limited, subject to change or cancellation without notice;
     

  • Promotions may be subject to eligibility criteria (such as service area, system type, or property type); and
     

  • Promotions cannot be combined with other discounts, coupons, or offers unless explicitly stated.
     

7.2 $49 Inspection – Scope & Limitations (Diagnostic Only)
If we advertise a $49 inspection or similar promotional inspection, it is subject to the following core limitations unless expressly stated otherwise in writing at the time of booking:

  • The promotional inspection covers one HVAC system only (e.g., one condenser/air handler pair). Additional systems may incur additional charges.
     

  • The inspection is diagnostic-only. It is intended to identify issues and provide recommendations, not to perform repairs or add materials.
     

  • The promotional fee excludes:
     

    • Parts or components;
       

    • Refrigerant;
       

    • Repairs or corrective work;
       

    • Maintenance beyond the defined scope of the promotion;
       

    • Service on extra systems or zones; and
       

    • Crawlspace or under-house access, or any other service not expressly listed in the promotional description.
       

  • Technicians may enter an accessible attic or other areas only for diagnostic purposes and only if it is reasonably safe and code-compliant to do so. If conditions are unsafe (e.g., structural issues, pests, hazardous materials), we may decline to enter or may require additional fees or conditions.
     

Any recommended repairs, replacements, or additional services beyond the promotional inspection will be quoted separately and performed only with your authorization.
 

7.3 Estimates and Changes

  • Any pricing or cost ranges shown on the Site or in ads are estimates only and subject to change based on onsite evaluation, system condition, access, code requirements, and other factors.
     

  • After inspection, our technician may revise the estimated price if previously unknown or undisclosed conditions are discovered.
     

  • We are not obligated to honor promotional pricing or estimates if the property or system does not meet eligibility criteria, safety standards, or access requirements.

8. SCHEDULING, ACCESS, CANCELLATION & REFUNDS
 

8.1 Scheduling & Access
When you schedule service with Aerosphere Electric:

  • You agree to provide accurate information about the property and the nature of the issue;
     

  • You agree to ensure safe and reasonable access to the home, system(s), and work areas (including, where applicable, attic or outdoor units);
     

  • You agree that an adult (18+) authorized to make decisions and approve work will be present at the scheduled time or reachable by phone.
     

We reserve the right to decline or stop work if conditions are unsafe, unsanitary, or otherwise unsuitable (e.g., exposed wiring, structural hazards, aggressive animals, lack of safe access).
 

8.2 Cancellation and Rescheduling
Unless otherwise required by law or specified in a written agreement with you:

  • You must cancel a scheduled promotional visit (such as a $49 inspection) at least 48 hours in advance to receive a refund of any prepaid inspection fee.
     

  • You are generally allowed one free reschedule with reasonable advance notice (e.g., at least 48 hours).
     

  • Late cancellations, no-shows, or situations where our technician arrives but cannot gain access due to your acts or omissions may result in a fee or forfeiture of any prepaid inspection or trip charge.
     

8.3 After-Hours, Emergency & Holiday Service
Service requested outside normal business hours, on weekends, or on holidays may:

  • Be subject to technician availability; and
     

  • Incure additional fees or higher rates, which will be disclosed to you at or before the time of scheduling whenever reasonably possible.
     

8.4 Refunds
Refund eligibility for services beyond a promotional inspection will typically be governed by:

  • The specific service agreement, work order, or invoice terms provided at the time of service; and
     

  • Applicable California law regarding contractor services.
     

Where permitted by law, refunds may be limited if substantial work has already been completed or materials have been purchased on your behalf.
 

 

 

9. OWNERSHIP & INTELLECTUAL PROPERTY RIGHTS
 

9.1 Site Ownership
The Site, including all text, graphics, logos, icons, images, audio/video clips, software, and other content (“Site Content”), is owned by or licensed to Aerosphere Electric and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

 

9.2 No License by Implication
Except for the limited license granted in Section 4, you are not granted any license or right in or to any intellectual property owned or controlled by Aerosphere Electric or its licensors. Any unauthorized use of Site Content is strictly prohibited.

 

9.3 Trademarks
Names, logos, and slogans displayed on the Site (including “Aerosphere Electric” and any associated marks) are trademarks or service marks of Aerosphere Electric or its licensors. You may not use these marks without prior written permission.


 


10. BACKUSER SUBMISSIONS & FEED

 

10.1 Submissions
If you submit any content through the Site or other channels—such as reviews, testimonials, suggestions, photos, or feedback (collectively, “Submissions”)—you:

  • Represent and warrant that you have the right to submit the Submissions; and
     

  • Grant Aerosphere Electric a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, display, distribute, and otherwise exploit the Submissions in any media, for any lawful business purpose (including marketing), without compensation to you.
     

10.2 No Obligation
We are not obligated to use any Submission and may remove any Submission at any time for any reason.


 

 

11. THIRD-PARTY WEBSITES & SERVICES
 

The Site may contain links to third-party websites or services (including social media platforms). Aerosphere Electric does not control and is not responsible for the content, privacy practices, or terms of any third-party websites or services.

Your use of third-party websites or services is at your own risk and subject to the terms and policies of those third parties. Links on the Site do not imply endorsement or sponsorship by us.

12. DISCLAIMERS OF WARRANTIES
 

THE SITE AND ALL CONTENT ON THE SITE ARE PROVIDED “AS ISAND AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, AEROSPHERE ELECTRIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF:

  • MERCHANTABILITY;
     

  • FITNESS FOR A PARTICULAR PURPOSE;
     

  • TITLE; AND
     

  • NON-INFRINGEMENT.
     

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free;
     

  • Any defects will be corrected;
     

  • The Site or the server that makes it available are free of viruses or other harmful components; or
     

  • The information on the Site is complete, accurate, or up to date.
     

Nothing in this section is intended to limit warranties or rights that cannot be limited under applicable law, including warranties related to services actually performed at your property, which may be subject to specific written service agreements or manufacturer warranties.

13. LIMITATION OF LIABILITY
 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AEROSPHERE ELECTRIC OR ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS (COLLECTIVELY, “AEROSPHERE PARTIES”) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE;
     

  • ANY CONTENT OR INFORMATION ON THE SITE;
     

  • ANY COMMUNICATIONS OR INTERACTIONS BETWEEN YOU AND AEROSPHERE ELECTRIC RELATED TO THE SITE; OR
     

  • THESE TERMS,
     

REGARDLESS OF THE FORM OF ACTION (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT WE ARE FOUND TO HAVE ANY DIRECT LIABILITY TO YOU ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS (US $100); OR (B) THE AMOUNTS YOU HAVE PAID TO US THROUGH THE SITE FOR THE SPECIFIC ONLINE TRANSACTION AT ISSUE.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for personal injury caused by our negligence, or for our fraud or intentional misconduct.

14. INDEMNIFICATION
 

You agree to defend, indemnify, and hold harmless the Aerosphere Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Site;
     

  • Your violation of these Terms;
     

  • Your violation of any applicable law or regulation; or
     

  • Your violation of any rights of a third party (including intellectual property, privacy, or property rights).
     

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.

This section does not require you to indemnify us for any unconscionable commercial practice or for our fraud, deception, or willful misconduct.

15. GOVERNING LAW; BINDING ARBITRATION & CLASS ACTION WAIVER
 

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
 

15.1 Governing Law
These Terms and your use of the Site are governed by the laws of the State of California, without regard to its conflict-of-law rules, and by applicable federal law.

15.2 Agreement to Arbitrate
Except as described in Section 15.5 below, you and Aerosphere Electric agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site (“Dispute”) shall be resolved exclusively by binding arbitration on an individual basis, and not in court.

 

15.3 Arbitration Procedures
Arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable rules, as modified by this Section. Unless we agree otherwise, arbitration will take place in Orange County, California, or by telephone or video conference to the extent permitted by the arbitrator.

The arbitrator will have the authority to award the same damages and relief that a court could (subject to the limitations in these Terms) and must follow these Terms as a court would. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

 

15.4 Class Action Waiver
YOU AND AEROSPHERE ELECTRIC AGREE THAT ANY DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION (EXCEPT AS TO PAGA CLAIMS WHERE A REPRESENTATIVE WAIVER IS UNENFORCEABLE BY LAW).

You and Aerosphere Electric expressly waive any right to participate in or bring a class action, class arbitration, or other representative proceeding against the other party, to the fullest extent permitted by law.
 

15.5 Exceptions to Arbitration
This arbitration agreement does not require arbitration of:

  • Individual claims that qualify for and are filed in small claims court;
     

  • Claims seeking solely injunctive or other equitable relief related to misuse or infringement of intellectual property rights; or
     

  • Certain representative claims under the California Private Attorneys General Act (PAGA) or other private attorney general laws, to the extent a court of competent jurisdiction determines that a waiver of such representative claims is unenforceable under applicable law not preempted by the Federal Arbitration Act.
     

15.6 Right to Opt Out of Arbitration
You may opt out of this arbitration agreement by sending an email to moediab@aerosphereelectric.com within 30 days of the date you first accept these Terms (or the date we first notify you of this arbitration provision, whichever is later). Your opt-out email must include:

  1. Your full name;
     

  2. Your address;
     

  3. Your phone number; and
     

  4. A clear statement that you wish to opt out of the arbitration agreement in the Aerosphere Electric Terms & Conditions.
     

Opting out of arbitration will not affect your ability to use the Site, but you and Aerosphere Electric will retain the right to resolve Disputes in court (subject to applicable law and jurisdictional requirements).
 

15.7 Jury Trial Waiver
If a Dispute proceeds in court rather than arbitration for any reason, you and Aerosphere Electric waive any right to a jury trial to the fullest extent permitted by law.


 

 

16. INTERNATIONAL USE
 

The Site is controlled and operated from the United States and is intended primarily for users located within the United States. We make no representation that the Site or its content is appropriate or available for use outside the U.S.

If you access the Site from outside the U.S., you do so at your own risk and are responsible for compliance with local laws.

17. AVAILABILITY; SUSPENSION & TERMINATION
 

We may modify, suspend, or discontinue any part of the Site (or access to the Site) at any time, for any reason, without notice or liability. Upon suspension or termination of your access to the Site, the rights and licenses granted to you under these Terms will immediately end, and you must stop using the Site.

18. RESERVATION OF RIGHTS
 

All rights not expressly granted to you in these Terms are reserved by Aerosphere Electric and its licensors. No rights are granted by implication, estoppel, or otherwise. Any unauthorized use of the Site for any purpose is prohibited.

19. MISCELLANEOUS
 

  • Entire Agreement. These Terms, together with the Privacy Policy and any specific service agreements or work orders you sign with us, constitute the entire agreement between you and Aerosphere Electric regarding the Site and supersede any prior agreements or understandings about the Site.
     

  • Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
     

  • No Waiver. Our failure to enforce any provision of these Terms will not be a waiver of our right to enforce them later. Any waiver must be in writing and signed by an authorized representative of Aerosphere Electric.
     

  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction.

20. COPYRIGHT NOTICE
 

Unless otherwise indicated, all materials on the Site are copyrighted by Aerosphere Electric. You may not copy, reproduce, download, distribute, or create derivative works from any Site materials without our prior written consent, except for your personal, non-commercial use of the Site as authorized in these Terms.
